The South African Nursing Council
Regulations Regarding Registers
The Minister of Health, in terms of section 11(1) of the Nursing Act, 1957 (Act
69 of 1957), has approved of the following regulations regarding registers, made
by the South African Nursing Council in substitution for the regulations
published under Government Notice R. 938 of 28 June 1963, as amended by Notices
R. 70 of 17 January 1964, R. 831 of 27 May 1966 and R. 61 of 19 January
1968:-
Particulars to be entered in the registers
1. The following particulars shall be entered
in the register in respect of each person:-
(a) Full names;
(b) residential address;
(c) the year of registration;
(d) the qualification registered and the year in which it was obtained
or that registration has been granted under section 12(2) of the Act.
Admission to the registers
2. (1) (a) A person who has complied
with the prescribed requirements for registration as a nurse or as a midwife
shall be registered with effect from the date on which the prescribed course was
completed, or with effect from the date on which the prescribed examination was
successfully taken, whichever date is the later.
(b) A certificate of
registration shall be issued in a form determined by the Council.
(2) (a) An
application for registration of a qualification obtained from another body shall
be submitted in the form of Annexure A and shall be accompanied by the following
(if a document is in a language other than Afrikaans, English, Flemish or Dutch,
the original shall be accompanied by a sworn translation):-
(i) The original certificate of qualification;
(ii) a
statement by the issuing authority that the certificate of qualification is
still valid;
(iii) such details of the course and examination as the
Council may consider necessary;
(iv) if the applicant did not undergo
the course through the medium of either Afrikaans, English, Flemish or Dutch, a
certificate satisfactory to the Council that the applicant is proficient in the
reading, writing and speaking of either Afrikaans, English, Flemish or Dutch.
The proficiency shall be such that the applicant can take and give instructions
for the nursing of patients;
(v) such other information as the Council
may determine;
(vi) an application fee of three hundred and twenty-eight rand
and ninety-five cents (R328,95), excluding VAT, in
respect of each qualification; provided that the fee shall not be payable in
respect of a qualification obtained in the Republic or the Territory of
South-West Africa. The fee shall not be refunded if the application is
withdrawn, or abandoned, or whatever the outcome of the application may be. The
Council may require proof of the authenticity and validity of the documents
submitted.
[ The above amount is effective from 17 November 2006.
The amount was previously R300,00, excluding VAT. ]
(b) If an application is granted, the applicant shall be registered on payment
of a fee of-
(i) fifty-five rand and twenty-six cents (R55,26), excluding
VAT, in respect of each
qualification obtained in the Republic; and

The amount was previously R50,00, excluding VAT. ]
(ii) two hundred and nineteen rand and thirty cents (R219,30),
excluding VAT, in respect of each qualification obtained outside the Republic.
[ The above amount is effective from 17 November 2006.
The amount was previously R200,00, excluding VAT. ]
(c) A
certificate or registration shall be issued in a form determined by the Council.
Registration of additional qualifications
3. (1) (a) A prescribed
additional qualification shall be registered on the date on which the prescribed
course was completed, or on the date on which the results of the prescribed
examination were published, whichever date is the later.
(b) A certificate of
registration shall be issued in a form determined by the Council.
(2) (a) An
application for registration of a qualification obtained from another body shall
be submitted in the form of Annexure B and shall be accompanied by the following
(if a document is in a language other than Afrikaans, English, Flemish or Dutch,
the original shall be accompanied by a sworn translation):
(i) The
original certificate of qualification;
(ii) a statement by the issuing
authority that the certificate of qualification is still valid;
(iii) such details of the course and examinations as the Council may consider
necessary;
(iv) such other information as the Council may determine;
(v) an application fee of three hundred and twenty-eight rand
and ninety-five cents (R328,95), excluding VAT, in respect of each
qualification; provided that the fee shall not be payable in respect of a
qualification obtained in the Republic or the Territory of South-West Africa.
The fee shall not be refunded if the application is withdrawn, or abandoned, or
whatever the outcome of the application may be. The Council may require proof of

(b) If an application is granted, each qualification shall be registered on
payment of a fee of-
(i) one hundred and nine rand and sixty-five cents (R109,65),
excluding VAT, in respect
of such qualification obtained in the Republic; and

The amount was previously R100,00, excluding VAT. ]
(ii) two hundred and nineteen rand and thirty cents (R219,30),
excluding VAT, in respect of such qualification obtained outside the Republic.
[ The above amount is effective from 17 November 2006.
The amount was previously R200,00, excluding VAT. ]
(c) A certificate of registration shall be issued in a form determined by the
Council.
Annual fee
4. (1) A registered person shall pay a fee of one
hundred and eighty-six rand and eighty-four cents (R186,84), excluding VAT, in respect of each calendar year or where applicable in
respect of a portion of a calendar year in the case of persons registered under
section 12(2) of the Act: Provided that a person who has reached the age of
seventy (70) years may on written application be exempted from paying the fee.
[ The above amount is effective from 17 November 2006 and does not apply to annual fees in respect of the
2006 calendar year. The
above amount does not apply to annual fees in respect of the 2007 calendar years
if the annual fee was paid before 17 November 2006. The amount was previously
R169,30, excluding VAT. ]
(2) The fee becomes payable on 1 July of the year preceding the year for which
it is due and shall be paid not later than 31 March of the year for which it
is due.
(3) The fee may not be paid before 1 July of the year preceding the year for
which it is due.
(4) The fee is not payable in respect of the calendar year during which a
person is registered for the first time under the Act.
(5) A receipt shall be
issued in a form determined by the council.
(6) The annual fee prescribed in subregulation (1) is subject
to an annual increase that shall not exceed the average annual percentage change
in the Consumer Price Index (CPI) for the previous year.
Removal from the registers
5. (1) The name of a person shall be removed from the
register-
(a) on death;
(b) by request, provided a sworn statement shall be lodged in a form
determined by the Council;
(c) on failure to pay the annual fee
prescribed under regulation 4. The date of removal shall be 1 April of the
year concerned;
(d) by resolution of the Council in terms of the Act.
(e) on expiry of the period of registration under section 12(2) of
the Act.
(2) The name of a person may be removed from the register if a
qualification by virtue of which registration was granted under regulation 2(2)
is withdrawn, cancelled or suspended by the issuing authority because of conduct
which in the opinion of the Council, is improper or disgraceful.
Restoration to the registers
6. (1) An application for restoration
shall be lodged in a form determined by the council, together with the annual
fee for the current calendar year and-
(a) if the
applicant's name was removed under regulation 5(1)(b), an amount of fifty-eight rand
and seventy-seven cents (R58,77), excluding VAT, irrespective of the number of qualifications in which restoration is
desired;

amount was previously R52,63, excluding VAT. ]
(b) if the applicant's name was removed for any other reason,
an amount of three hundred and four rand and thirty-nine cents (R304,39),
excluding VAT, irrespective of the number of
qualifications in which restoration is desired.

amount was previously R276,32, excluding VAT. ]
(2) A certificate of
restoration shall be issued in a form determined by the council.
Change of name
7. A registered person shall specifically notify the Council in
writing of a change of name by marriage or other process of law. The council may
require documentary or other proof of the change. In the case of marriage, the
marriage certificate shall be lodged. Documents shall be returned
Change of residential address
8. A registered person shall specifically notify
the Council in writing of a change of residential address.
Application to the territory of South-West Africa
9. These
regulations shall also apply in the territory.
